
GENERAL SALE CONDITIONS: SALE TO INDIVIDUALS BY MEANS OF INTERNET.hese conditions regulate sale between, on the one hand, the Royal Mint of Belgium (RMB), Boulevard Pachéco , 32 in 1000 Brussels “the salesman” and, on the other hand, the persons who want to buy by means of the Internet site of the salesman, www.europemint.eu, hereafter called “the customer”.These conditions concern at exclusive title only the natural not - trading persons. The customer whom on the site would want to buy, explains to have the full legal capacity.If any condition should be missing, then these will become stipulated by the uses which applies sale, of which the companies have seat in Belgium in the area of the distance sale.ARTICLE 1 – OBJECT.The present conditions apply to the sale on line. They aim at defining the methods of sale between the salesman and the customer, of the order to the services, in placing by the payment and the delivery.They regulate all the stages necessary to the placing of the order and ensure the follow-up of this order between the contracting parts. The parts are appropriate that their relations will be controlled exclusively by the present general conditions.ARTICLE 2 - ORDERThe customer has the possibility of placing his order on line starting from the references of the site.The order can be recorded on the site only if the customer were clearly identified.Any order is worth acceptance of these general conditions of sale, as well as prices (cf. article 6) and description of the market products.The salesman commits himself delivering the orders received on Internet site only within the limit with stocks available of the products. If the article is exhausted, the customer will be informed by it and, if necessary, a refunding will take place. The salesman cannot be held responsible for the damage resulting from the unavailability of an article.A valid order is concluded between the salesman and the customer when the salesman receives the confirmation of your order on his site.The salesman can however decide to subordinate the validity of the order to other conditions. The salesman reserves the right to refuse an order, in particular in the event of non payment of former invoices, purchase orders incomplete or incorrect, to limit the amount of an order and to deliver the order against refunding if necessary.ARTICLE 3 - DELIVERYThe delivery will be made to the bill-address that the customer will have determined.The salesman commits himself carrying out the deliveries of the articles ordered, as soon as possible.The salesman puts all works about it to guarantee that the customer receives his order within the times mentioned on his site. However these delivery periods are mentioned only as information and the salesman cannot be held responsible for the possible delays.Any problem of delivery (missing or damaged article) must be announced to us within four working days on the telephone + 32 2 221.07.11 starting from the reception of the order. The corresponding article which was turned over, must then arrive at the salesman within seven days after reception by clearly requiring the exchange or refunding.The sale is definitively concluded after a legal seven working days time starting from the following day after the delivery day.ARTICLE 4 - MODES OF PAYMENTDuring the validation of the order, only two modes of payment are accepted:1) BY BANK CARDThe customer will indicate his number of Visa card or Mastercard, the check number, as well as the scratch date. The account Aimed or Mastercard of the customer will be output after the confirmation of order.2) BY TRANSFER TO BE CARRIED OUT BY ELECTRONIC WAY (one line banking)ARTICLE 5 - ARTICLES AND Prijs PROPOSED ON THE SITE.All the articles suggested by the salesman are described in all good faith and most accurately possible. The offers and prices are valid the day of the consultation on the site. The prices indicated include the VAT. The salesman reserves the right to modify his prices in particular, but not exclusively, following a modification of the legislation in force.The products presented on the site or in its catalogues and folders are proposed in limited stocks available. The salesman puts all works about it so that the ordered articles are available.In accordance with the Belgian law on the commercial practices the load of the risks of damage or losses falls to the salesman.RTICLE 6 - RETURN/EXCHANGEThe Belgian law on the commercial practices and the information and the costumer protection of July 14th, 1991 authorizes the consumer to notify to the salesman that he/she gives up his purchase in the 7 working days which follow the delivery date.If an article is not appropriate, the salesman commits himself to exchange it or refunding it, in so far as the article is in its packing of origin. If possible, the customer will indicate the reasons for return on a document which join the parcel.The expenses sustained of sending back the article (s), will be paid by the customer.If the received article does not correspond to the ordered article or if it is damaged, the salesman will refund or exchange the article as soon as possible.The salesman has the right to refuse or not to refund the turned over articles when those were damaged by the customer.When the customer turns over an article, the salesman will refund directly by transfer on the bank account indicated by the customer. The banking co-ordinates of the customer will be clearly mentioned on the invoice of sending which will accompany the turned over articles.Any return must be made in the seven working days shortly after the day of the delivery, by registered letter, to the Royal Mint of Belgium, to the attention of the Mintmaster, Boulevard Pachéco, 32 to 1000 Brussels.The customer must make validate the proof of reforwarding by the Post office.In the event of abusive return, the salesman reserves the right to refuse any further order.The salesman cannot grant of guarantee on the deterioration of surface of his products.ARTICLE 6 - RETURN/EXCHANGEThe Belgian law on the commercial practices and the information and the consumer protection of the July 14,1991 authorizes the consumer to notify to the salesman that it/it gives up his purchase in the 7 working days which follow the delivery date.If an article is not appropriate, the salesman commits himself to exchange it or refunding it, in so far as the article is in its packing of origin. The banking co-ordinates of the customer will be clearly mentioned on the invoice of sending which will accompany the turned over articles.Any return must be made in the seven working days from the shortly after the day of the delivery, by registered letter, with the Royal Mint of Belgium, the attention of the Mintmaster, Boulevard Pachéco, 32, 1000 Brussels.The customer must make validate the proof of re forwarding by the Post office.In the event of abusive return, the salesman reserves the right to refuse a further order.The salesman cannot grant of guarantee on the deterioration of surface of his products.ARTICLE 7 - SIGNATURE AND PROOFAny customer of the non titular site of a number of customer will have to follow a preliminary procedure of inscription allowing him to obtain his number of customer.In all the cases, the final validation of the order implies acceptance by the customer of this one, in his entirety and at the Prijs indicated.This validation is worth signature and express acceptance of all the operations carried out on the site.ARTICLE 8 - LIMITATION OF RESPONSIBILITYThe salesman could not be held responsible for a damage rising from the fraudulent use of his Internet site.ARTICLE 9 - POLICY OF RESPECT OF THE PRIVATE LIFEThe salesman reserves the right to collect data on the customer when this one made an order.All the personal data are intended for the internal use of the salesman.In accordance with the law of the December 8th ,1992 relating to the protection of the life deprived with regard to the processings of data in personal matter, the customer constantly has the right of access and of correction to his data as of the right of opposition if it does not wish any more to be informed.With this intention, he will write to the salesman, service customers, Boulevard Pachéco, 32 1000 Brussels by specifying his co-ordinates.ARTICLE 10 - BONDS AND CONTENTS OF THE SITEThe site of the MRB contains bonds towards sites not belonging to him. It cannot be held responsible for the contents of these sites nor of the consequences of their use.The information disseminated on our site is regularly updated and checked. The salesman cannot however be held responsible for errors or possible direct or indirect damage being able to rise from your access or use of this site, or a damage or virus which could affect your computer or another computer equipement.ARTICLE 11 - INTELLECTUAL PROPERTYAll the elements of the site of the salesman, which they are visual or sound, including subjacent technology, are protected by the royalty, of the marks or the patents and more generally by the intellectual property.The customer who has an Internet site on a purely personal basis and which wishes to place, for a personal use, on his site a simple bond returning directly to the homepage of the site of the salesman, must obligatorily request the authorization of it from the Royal Mint of Belgium, to the attention of the Mintmaster, Boulevard Pachéco, 32 to 1000 Brussels.It will not act in this case of an implicit convention of affiliation.Any hypertext link returning to the site of the salesman and using the technique of the framing or of in-line linking is formally prohibited.In all the cases, any bond, even tacitly authorized, will have to be withdrawn on request from the salesman. They are the exclusive property of the salesman.ARTICLE 12 - NULLITYOn the assumption that one of the clauses of this contract would be null and not avenue by a change of legislation, regulation or by a decision of court, that could not in no case to affect the validity and the respect of these general conditions of sale.ARTICLE 13 - DURATIONThe present conditions apply throughout all setting on line of the services offered by the salesman.ARTICLE 14 - CONSERVATION AND FILINGS OF THE TRANSACTIONS - PROOFThe computerized registers, preserved in the information processing systems of the salesman under reasonable conditions of safety, will be regarded as the evidence of the communications, the orders and the payments occurred between the parts.The filing of the purchase orders and the invoices is carried out on a reliable and durable support.ARTICLE 15 - APPLICABLE LAW AND COMPETENCEThe present conditions are subjected to the Belgian law.In the event of litigation, the Belgian right is valid and only the courts of the legal district of Brussels are qualified. |
